[WardFive] Re: [ward5] ANC 5B FOIA Request

Good Morning,

Why do people need to have a copy of this and then to use a FOIA form?  If this is about the wondrous band who would like to see another Outdoor Seating and Liquor Licensed Restaurant that is White owned but stood by silently and watched the prejudice/racist approach to the Black owned Cafe for Years but said nothing.  How nice!!!!  I sure didn't see anyone showing up for John Feeley's SMD meetings and asking for copies of what occurred!!!.

Maybe the Padous will be protesting this Liquor License because of traffic and parking -- I don't think they have any parking at all over there and I do believe that this is MUCH MORE CLOSE to their house.

I wonder if the folks from FORIA will be weighing in on this or this is still out of their jurisdiction.  Maybe, they will they use their exception card like when they needed to vote in the BNCA/901 Monore development issue.

Menomale, Little Ricky's and now this --- Just so we are clear, I have no issue with any of these establishments but just the folks who call themselves fair but show their racist anchors through their actions and lack thereof..

What a Memory of actual life here in my Brookland Neighborhood.

Hello Ms. Hernandez - Thank you for your email.  Please be advised that the tape recorder device and all its recorded contents (including a verbatim recording of the Sat, Apr. 27, 2013 5B04 Single Member District meeting) are my personal affects, purchased with my personal monies and, as such belong solely,  exclusively and privately to me.

Additionally, please be advised, and in accordance with Section 1-309.11(b)(1) and Section 1-309.11(c) of Subchapter V. Advisory Neighborhood of the D.C. Code wherein "required monthly" or "special" meetings" are discussed regarding ANC "official action," Sat's 5B04 "single member district meeting" is neither (1) required by DC law nor (2) a forum wherein "official action" is taken by commissioners.

I stated to all attendees that Ward 5 ANCs are likely the only ANCs in the city (because of our commitment to full vetting among constituents) who hold DC-law mandated "regular monthly", "special" and also, non-required single member district meetings

With that, your request to obtain my personal tape recorder and its contents from is DENIED.

If you have additional questions regarding the legality of this response, I encourage you to contact the DC Office of the Attorney General.  For your convenience, I have copied Joshua Turner of the OAG's office on this email.

Very kind regards,

Subject: ANC 5B FOIA Request

Dear Chairman Rivens-Smith and Vice-Chairman Steptoe:

I am writing to submit a Freedom of Information Act (FOIA) request for an electronic copy of the audio recording made by ANC 5B04 Commissioner Steptoe at the SMD meeting she held on April 27, 2013 at the ANC 5B office. I am making this request on behalf of my blog, The Brookland Bridge (http://www.brooklandbridge.com/) and therefore request a media exemption from any fees associated with the time spent fulfilling this FOIA request.

If the audio file is too large to be emailed, I would like the file provided to me on a Universal Series Bus (USB) drive (commonly known as a thumbdrive or "memory stick"). I would be happy to provide a blank USB drive to ANC 5B for this purpose—please let me know if that is necessary and I will drop one off at the ANC 5B office. When the file is ready, I can pick it up at the ANC 5B office.

Please let me know if any additional information is required to complete this request. I can be reached at this email address or at the contact information below.

Sincerely,

Shani Hernandez
